What it is for

When you leave, you must return the home as you received it, except for what has worn out with time or through an unavoidable cause (artículo 1561 del Código Civil).

If its condition was not put in writing at the start, the law presumes you received it in good condition, unless you prove otherwise (artículo 1562 del Código Civil). And you answer for deterioration, unless you prove it was not your fault (artículo 1563 del Código Civil).

That is why it pays to put it in writing on key day: if there was already a stain, a dent or something broken, there is a record that it was not you.

How to do it well

  • Do it on the day you get the keys, or in the first few days.
  • Go through the flat room by room and also note what does not work properly.
  • Take photos of any damage and of the meter readings.
  • Both of you sign it and each keeps a copy. If the landlord will not sign, send it by a means that records the date.

Keep in mind

There is no official inventory form: this document helps you keep a record, and its weight as evidence depends on how it was made and on whether you both signed it.

This tool is general information, not legal advice: if there is a dispute, confirm your case with a professional.
