Letter to claim your rental deposit back

[City], [date]

To the attention of [Landlord's or agency's name]

Subject: request for the return of the deposit for the rental at [Address of the home]

Dear [Landlord's or agency's name],

On [key-handover date] my rental contract for the home at [Address of the home] ended and I handed back the keys that same day, with the home in good condition.

Under article 36.7 of the Urban Leases Act (Ley de Arrendamientos Urbanos), at the end of the contract the parties must sign an end-of-tenancy document recording the state of the home (where applicable, I attach that document); if it was not signed, or it records no damage, the home is presumed, unless proven otherwise, to have been handed over in an adequate state of repair.

Under article 36.4 of the Urban Leases Act (Ley de Arrendamientos Urbanos), the balance of the deposit that must be returned — [Deposit amount] in my case — accrues legal interest once one month has passed since the keys were handed back, a period that has already elapsed.

I therefore request the return of the deposit ([Deposit amount]) or, where applicable, the remaining balance with justification for any deduction you apply.

I look forward to your reply.

Yours sincerely,

[Your full name]
