Extraordinary two-year rental extension in Spain: eligibility and request
The fifth final provision of RDL 29/2026 allows certain tenants to remain in their ordinary home for up to two additional years. It is not a universal extension and does not apply by itself: you must request it and prove that the contract and payments meet the requirements.

In short
- The contract had to be in force on 8 October 2026 and the mandatory extension must end before 31 December 2028; the rule also separately addresses expiry of tacit extension or tacit reconduction.
- You must be current on rent and have been current monthly during the preceding eight months. It is requested in yearly periods, up to two years, on the same terms.
- The landlord must accept unless an exception applies. The stressed-area extension takes preference and, from 15 November, coordination with successive RDL 28/2026 renewals is essential.

Which contracts qualify? New
Only ordinary-home leases subject to the LAU that were in force on 8 October 2026. It must be your ordinary home, not a temporary or tourist rental.
The main case is a mandatory extension under article 9.1 ending before 31 December 2028. The provision separately addresses expiry of the tacit extension under former articles 10.1 and 10.2, or tacit reconduction under the Civil Code.
The 2028 deadline is attached to the mandatory extension. If your contract is already in another period, do not read the requirement as if the text said the same for every case: have the specific scenario checked professionally.
Which payments must I prove?
You must be current on rent and have been current monthly during the eight months preceding the request. Gather receipts for those eight months and the current one.
If there is an earlier debt, the text does not turn this into a simple automatic procedure: being current and the monthly history are express requirements.
How do I request it, and how long does it last?
It applies upon tenant request: it does not arise automatically at expiry. Request it in writing, identify the contract and expiring period, attach payment evidence and keep proof of receipt.
The extension is granted in yearly periods up to a maximum of two additional years. The terms and conditions of the existing contract continue during that time.
You do not need a new request if you validly applied during the RDL 8/2026 period: RDL 29/2026's first transitional provision preserves those requests and communications. When that period ends, any new request is governed by RDL 29/2026. RDL 8/2026 was subsequently repealed, so it must not be used for new requests.
When can the landlord refuse?
Acceptance is mandatory as a general rule, but not when the parties agree other terms, sign a new contract or the landlord has communicated, within the article 9.3 periods and conditions, that they need to occupy the home for themselves or their relatives.
For this particular extension, need may be invoked even if early recovery was not expressly included in the contract, provided there is a genuine, accredited cause. That exception must not be confused with the general article 9.3 rule.
This extension also does not apply when landlord and tenant agree a renewal or a new contract with rent at least five per cent below the current rent.
Can I combine it with other extensions?
It is not incompatible with every protection, but it is incompatible with the stressed residential market area extension, which takes preference. If the home is in a declared and effective area, check that route first.
From 15 November 2026, vulnerability and stressed-area extensions are in articles 10.5 and 10.6. The vulnerability extension allows up to one year in its specified cases; the stressed-area extension allows up to three years in yearly periods. Their requirements differ from this general extension.
RDL 28/2026 coordination states that this extraordinary extension does not apply when the new successive renewal in article 10.1 applies. In other words: first establish whether the contract continues under the ordinary regime; the extraordinary extension must not duplicate that period.
What if the landlord has already given non-renewal notice?
If the extraordinary extension applies after valid non-renewal notice, the contract ends when the extension finishes, with no further notice required, unless the parties agree an extension or sign a new contract (RDL 28/2026, first additional provision).
At that point, non-renewal compensation under the new article 10 may be payable unless an exclusion applies. Valid notices predating RDL 28/2026's publication remain effective and do not generate that compensation, even if an extraordinary extension is subsequently obtained.
The notice date, extension type and new article 10 effective date must therefore be reviewed together.
The law behind this guide
The general extension is in the fifth final provision of Royal Decree-law 29/2026, in force since 8 October 2026. Its coordination with renewals and compensation is in Royal Decree-law 28/2026, which enters into force on 15 November 2026. Both are subject to validation by Congress.

Frequently asked questions
Does every tenant get two more years?
No. Contract type, validity, expiry and payment requirements apply. A request is also required, along with exceptions and preference rules.
Is the extension automatic when the contract ends?
No. You must request it and provide documents proving that you meet the requirements.
Can I apply if I owe a monthly payment?
The rule requires current payments and monthly payments during the preceding eight months. A debt may prevent you from meeting that requirement.
Can I choose between this and the stressed-area extension?
The stressed-area extension takes preference and is incompatible with this general extension. First check whether your home is in a declared and effective area.
If I applied under RDL 8/2026, must I apply again?
Not if the request or communication was validly made while that rule was in force. RDL 29/2026 treats it as valid without a new communication; a later request after that period is governed by RDL 29/2026.
What do I do now?
Check contract and date
It must be an ordinary home, in force on 8 October 2026 and fit one of the rule's expiry scenarios.
Review payments and other routes
Prepare eight monthly receipts and the current one. First check the preferred stressed-area extension or an ordinary renewal.
Request it in writing
Identify the contract and period, request yearly extensions, attach payment evidence and keep proof of receipt. Do not wait for it to apply itself.
